Terms of Service for the Minato Art Navi

Chapter 1. General

Article 1. Purpose

By communicating information about exhibitions of cultural and art activities conducted by people in Minato City or events and exhibitions held at cultural and art facilities in Minato City, Minato Art Navi (hereafter referred to as "this Site") will provide opportunities for citizens of Minato City and others to come into contact with the arts. The purpose is to achieve a rich cultural life for all people and to promote culture and the arts. This Site is operated by the Minato City Sports, Culture, and Health Foundation (Minato-ku Sports Fureai Bunka Kenko Zaidan) (hereafter referred to as "this Foundation").

Article 2. Terminology

The terms used in the Terms of Service for the Minato Art Navi (hereafter referred to as "the ToS") are defined as follows.

  1. "Users" shall mean all people who visit this Site and use it or try to utilize it.
  2. "Members" shall mean "artists" and "supporters" who have applied for membership in this Foundation and have been authorized.
  3. "Artists" shall mean individuals, organizations, or other entities that use this Site who are conducting cultural or artistic activities in Minato City, and trying to transmit information.
  4. "Supporters" shall mean cultural and artistic facilities in Minato City, individuals, organizations and other entities that use this Site and are trying to transmit information.
  5. "My Page" shall mean a function that members use to create, edit, and delete information that they want to publish on this Site. Information that has been authorized by this Foundation is published on this Site.

Article 3. Scope of These Terms

  1. Anyone can view this Site; however, using the services provided by this Site implies that you agree with articles 1 to 20 of the ToS.
  2. Individuals, organizations, facilities, and other entities that wish to publish on this Site shall agree with the member rules in articles 21 to 24 in addition to articles 1 to 20 of the ToS.

Article 4. Guarantee and Change of the Service Contents

  1. This Foundation does not guarantee that the services provided by this Site are free from defects or software problems.
  2. This Foundation may change the contents of the services and specifications provided by this Site in part or in whole without prior notification, and it may stop or cancel providing them.

Article 5. Utilization Limits

This Foundation may refuse use of this Site by individuals, organizations, facilities, and other entities that refuse to comply with the ToS and purpose of this Site, or that may abuse the services provided by this Site for illicit purposes.

Article 6. Prohibited Actions

The following actions or actions that may lead to similar circumstances are prohibited when using this Site.

  1. Actions that violate Japanese or local laws.
  2. Actions that violate social norms or public order and morals, and actions that violate the rights of third parties and may cause them harm.
  3. Actions that damage or interfere with computer equipment, software and the like used by third parties.
  4. Actions that damage or interfere with servers, network equipment, computer equipment, software, and the like used by this Foundation.
  5. Actions that involve acquiring the user IDs and passwords of third parties to impersonate them and use this Site.
  6. Actions that modify or copy documents, images, and other material made available on this Site.
  7. Actions that violate the rights of the copyright holders of documents, images, and other materials made available on this Site.
  8. Actions that illicitly upload documents, images, and other materials that do not concur with the purposes of this Site by forceful means, fraudulent means, by lying about their purpose, or by not clearly stating their purpose.
  9. Any other actions that interfere with the management of this Foundation or with the management and operation of this Site.
  10. Any other actions that this Foundation finds inappropriate.

Article 7. Copyrights

  1. The copyrights to the software and other tools used to produce this Site, and the copyrighted contents, designs, and other materials to be available lie with the holders of the copyrights before this Site was produced, this Foundation, and the company that subcontracted to produce this Site.
  2. The documents, image works, and other copyrighted materials made available on this Site are the property of the holders of the copyrights and property rights.
  3. Any parties that violate the rights, defame, or otherwise harm the copyrights or property rights of third parties by making copyrighted material of third parties available or by using copyrighted material of third parties will be responsible for any damages to the holders of the copyrights, etc.

  1. This Foundation does not guarantee the accuracy or reliability of the contents of articles on this Site.
  2. This Foundation cannot be held responsible for any damages incurred while using this Site.
  3.   7. This Foundation is not responsible for any damages incurred from the contents of third party web sites or from viewing or using such web sites that are linked to the articles, advertisements, or other materials on this Site.

Article 9. Advertisements

When there is a request for posting a culture or art related advertisement made to this Foundation, this Site can post such advertisements. The advertisement fees and posting periods shall be determined separately.

Article 10. Negotiations

In the event that there is a complaint from a user about information or other materials on this Site, this Foundation has the right to conduct negotiations between a member that has posted the information or other materials and the user that has filed the complaint in order to solve the issue. The member and user shall sincerely solve the issue.

Article 11. Governing Law and Presiding Court

  1. The use of this Site and interpretation and application of the ToS shall be under Japanese law unless stated otherwise.
  2. With respect to any disputes that may arise between this Foundation and users concerning the use of this Site, the Tokyo District Court will be the exclusive court of jurisdiction for the first trial unless stated otherwise.

Article 12. Modifications to the ToS

If this Foundation deems it necessary, it may modify the ToS without notifying the users. When modifications to the ToS are made, notifications will be posted on this Site, the official web site of this Foundation, or the official journal of this Foundation, and will be effective from that time onward.

Article 13. Links

In principle, links to the top page of this Site may be made freely, but we ask that we be notified of the name, contact information, and web site URL of the linking party through our contact form.

Article 14. Use of Personal Information

Personal information on this Site shall be handled according to the Personal Information Protection Guidelines of this Foundation. The personal information collected by this Foundation shall be used for the following purposes.

  1. For member registration procedures, and when it is necessary to confirm, edit, or delete registration contents.
  2. When it is necessary to confirm the location of supporter activities or their addresses.
  3. When it is necessary to contact a member about the contents of information they have posted.
  4. When this Foundation or a subcontractor of this Foundation uses the information for maintenance, operation, modification or other matters concerning this web site.
  5. When it is necessary to contact a member about the work of this Foundation that is not related to the operation of this web site.
  6. To analyze and utilize the usage trends of this web site.
  7. To reply to inquiries from users.

Article 15. Providing Personal Information to External Parties

This Foundation will not provide personal information to external parties except in the following cases.

  1. When personal information is included in information posted and made public according to the wishes of a member.
  2. When ordered by a court to disclose information based on a legal verdict or order, or when a government organization or other public organizations ask to refer to personal information based on a law.
  3. When this Foundation determines that a member is trying to use this web site in violation of the law or this web site's Terms of Service, and might cause damage to the rights, property, etc. of a third party or this Foundation.
  4. When already made public through publications, the mass media, etc.
  5. When this Foundation determines that it is an emergency and inevitable in order to protect the life, health, or property of an individual from danger.

Article 16. Deposition of Personal Information

When this Foundation subcontracts a third party for the purpose of maintaining, operating, or repairing this system, it will execute appropriate management and supervision to assure the security of personal information.

Article 17. Discretion in Providing Personal Information

Providing personal information is left up to the discretion of users. However, unless the necessary personal information is input, users will not be allowed to use this web site.

Article 18. Right to Request Disclosure of Personal Information

Chapter 2. Member Regulations

Article 21. Member Registration

Individuals, organizations, facilities, and other entities that wish to make information available on this Site must submit a member registration using the procedure below, and receive authorization from this Foundation.

  1. The individual, organization, facility, or other entities that wish to register as a member must make an application as either an "artist" or "supporter" from this Site. The name (organization name, facility name, etc.), address, telephone number, e-mail address and other information must be filled in truthfully and accurately.
  2. When registered information must be modified, information that can be modified on the Site can corrected by the members. With respect to information that cannot be corrected by members, a request should be sent to this Foundation with the inquiry form.

Article 22. Contents of the Service

Members can use the services below, depending on whether they are an artist or a supporter. However, this Foundation may terminate some services in part or in whole, or may cancel or modify them without prior notification.

  1. Services available to artists
    1. Articles introducing artist activities and images showing their works, etc. can be posted.
    2. Artist performances, exhibits and other event information can be posted.
  2. Services available to supporters
    1. Articles introducing supporter activities and facility information can be posted.
    2. Supporter events, exhibits and other event information can be posted.

Article 23. Member Compliance

Members shall comply with the ToS in using this Site, and have the following responsibilities.

  1. Members shall manage their passwords carefully, and shall take thorough measures to prevent third parties from using them.
  2. Members that upload information shall make sure that the contents are accurate.
  3. In principle, members shall only upload images to which they own the copyright, property right, etc. When this Foundation makes the decision to make an image public, members shall agree to publish the image on this Site.
  4. When a member itself uploads an image for which he/she does not own the copyright, property right, etc., he/she shall have received authorization from the party that owns those rights to upload the image to this Site. When this Foundation makes the decision to make an image public, members shall have received authorization from the owner of the rights to publish the image on this Site.
  5. If a member publishes a copyrighted material from a third party, uses a third party's copyrighted material that has been published, or otherwise acts in a way to violate the copyrights, property rights, etc. of a third party, then that member shall be responsible for any damages incurred by the copyright holder.

Article 24. Determining to Publish or Not Publish

This Foundation shall check the information uploaded by members to determine whether to publish it or not. Information that is applicable to the prohibitions described in Article 6 of the ToS shall not be published.
